What it requires
Paragraph 1 establishes the committee that assists the Commission and brings it within Regulation (EU) No 182/2011, the regulation that governs how member states control the Commission's implementing powers.
Paragraph 2 applies the examination procedure in Article 5 of that regulation to the implementing acts this Directive provides for, including the technical specifications under Article 15(3) and the amendment or repeal of a technical specification under Article 21(4).
The article does not create a duty for an economic operator. It tells the operator how a technical specification will be made and changed, which is useful when a file relies on one.
In practice
When a file relies on a technical specification rather than a harmonised standard, record the implementing act that adopted it, the committee procedure and the date. That record matters if the specification is later amended or repealed after a safeguard case, because the file then needs a new basis.
What to do
- Check whether a technical specification you rely on was adopted through this procedure.
- Watch for amendments after a safeguard decision.
- Record the citation in the standards register.
Evidence to keep
- The implementing act citation and its Official Journal reference.
- The standards register entry.
- The change note when a specification is amended or repealed.
Dates
- 2025-06-28Implementing acts operate as the requirements apply. (Article 31(2))

Where teams get this wrong
A technical specification is not a harmonised standard. It is a fallback adopted through a committee procedure, and it can be amended or repealed after a safeguard case.
