What it requires

Paragraph 1 applies where objections are raised against a national measure or the Commission has good evidence that a national measure breaks Union law. The Commission consults the member states and the operator, evaluates the measure and decides whether it is justified, addressing the decision to all member states and communicating it to the operator.

Paragraph 2 gives the consequence. If the measure is justified, every member state must ensure the offending product leaves its market and tell the Commission. If it is unjustified, the member state withdraws its measure.

Paragraphs 3 and 4 deal with the cause. Where the non-compliance comes from a shortcoming in a harmonised standard, the Commission uses the procedure in Regulation (EU) No 1025/2012. Where it comes from a technical specification, the Commission adopts implementing acts to amend or repeal the specification.

In practice

The safeguard route is rare, but the file work is the same as an inspection. Keep the Commission decision and the national measure together with the product file, and record which standard or specification was found deficient. If the cause is a standard, review every model that relied on the same clause, not only the model in the case.

What to do

  • Follow the Commission decision and the member state instructions.
  • Keep the product file available through the safeguard process.
  • Record which standard or specification is said to be deficient where that is the cause.

Evidence to keep

  • The Commission decision and the national implementing measure.
  • The withdrawal record across member states.
  • The standard or specification review note where relevant.

Dates

  • 2025-06-28The safeguard route operates once the requirements apply. (Article 31(2))

Where teams get this wrong

A safeguard decision can turn on the standard rather than the product. If a harmonised standard is found deficient, every operator relying on that clause may need a file review, not only the company in the dispute.
