What it requires

Paragraph 1 requires adequate and effective means for compliance with the Directive. Paragraph 2 sets two routes. A consumer can go to a court, or to a competent administrative body, under national law to enforce the national measures. Public bodies, charities, associations and similar organisations with a legitimate interest may act, with the complainant's approval, for the complainant or alongside them in a judicial or administrative procedure.

Paragraph 3 removes public procurement procedures covered by the two procurement directives. Those procedures have their own review regime.

The practical effect is that accessibility non-compliance is not only a regulator risk. A consumer, or an organisation supporting a consumer, can bring the issue to a court or an administrative body in the member state where the service is provided or the product is made available.

In practice

Map the national enforcement route for each market: which court or administrative body, which body may act in support of a consumer, and what the complainant must show. That map belongs in the legal risk note, next to the penalty note, because a consumer action can arrive before a regulator ever inspects.

What to do

  • Keep a complaint route that produces a dated record.
  • Treat a consumer complaint as potential litigation evidence, not only a service ticket.
  • Check the national enforcement route in each member state of supply.

Evidence to keep

  • The complaint log and the response record.
  • The national measure and the enforcement route it creates.
  • The legal review of collective or representative action exposure.

Dates

  • 2025-06-28National enforcement means operate as the measures apply. (Article 31(2))

Where teams get this wrong

A company that resolves complaints quietly but never records the resolution has no evidence if an organisation later supports the same complainant. The record is the only durable answer.
