What it requires

Section VI defines what has to be true before the Article 24(2) presumption can be used. It does not create a separate requirement set; it points back to the sections that do.

For products, three elements must match. The accessibility of the information about the product's functioning and accessibility features must comply with point 1 of Section I. The accessibility of the interface features and functionality design must comply with point 2 of Section I. The accessibility of the packaging and of the installation, maintenance, storage and disposal instructions, except for self-service terminals, must comply with Section II.

For services, the accessibility of those features and functions must match the corresponding requirements in the service sections of Annex I. The practical consequence is a mapping duty: a tender or another Union act can only rely on the presumption for the features that have been tested against the named section.

In practice

Keep the claim narrow. If the tender relies on a compliant checkout under Article 24(2), the mapping should name the e-commerce clause, the test performed and the date. It should not describe the whole service as accessible, because the presumption only reaches the feature that was tested.

What to do

  • Map each feature claimed under Article 24(2) to the Section I, II or service clause it meets.
  • Test the feature against that clause, not against a general accessibility claim.
  • Record the scope of the claim so it is not read wider than the evidence.

Evidence to keep

  • A feature-to-clause map with test results.
  • The public information and instructions that support the product claim.
  • The service information that supports the service claim.

Dates

  • 2025-06-28The presumption applies as the requirements apply. (Article 31(2))

Where teams get this wrong

The presumption is feature-specific. A compliant website does not support a claim about a payment terminal, and a compliant terminal does not support a claim about the service behind it.
