What it requires

Paragraph 1 required member states to adopt and publish the laws, regulations and administrative provisions needed to comply by 28 June 2022, and to communicate the text to the Commission immediately. Paragraph 2 required the national measures to be in force from 28 June 2025.

Paragraph 3 is the only derogation on the date. A member state may decide to apply the measures for the obligations in Article 4(8), the answering of 112 emergency communications, no later than 28 June 2027. It is not a general extension and it does not move the product or service dates.

Paragraph 4 requires the national measures to cite the Directive, or to carry a citation alongside them when they are published. Paragraph 5 requires communication of the main national measures. Paragraph 6 requires a member state that uses the Article 4(4) built-environment option to communicate those measures and report on implementation.

In practice

Use the dates in this order: 28 June 2022 was the legislator's deadline, 28 June 2025 is when the duties apply, and 28 June 2027 is only the 112 derogation. If a board paper still says 2027 is the deadline, correct it with Article 31(3) in the footnote and replace the programme date with 2025. A plan built on the wrong date is the most expensive error in this file.

What to do

  • Use 28 June 2025 as the application date for products and services.
  • Check the national transposition text in each member state of supply.
  • Treat 28 June 2027 as relevant only to the 112 duty and only where the derogation was used.
  • Do not describe 28 June 2022 as a deadline you can still act on; it was the legislator's deadline.

Evidence to keep

  • The national transposition instrument for each member state, with its date.
  • A note of whether the member state used the Article 31(3) derogation.
  • The application date used in the product or service plan.

Where teams get this wrong

The date most often misquoted is 28 June 2027. It is a narrow derogation for emergency communications, not the transposition deadline and not the start of the product or service duties.
