What it requires
Paragraph 1 covers five product groups first supplied in the Union from 28 June 2025: consumer general purpose computer hardware and the operating systems for it; named self-service terminals (payment terminals, cash machines, machines for tickets, check-in and interactive information that are not built into a vehicle); consumer terminal equipment used for electronic communications services; consumer terminal equipment used to access audiovisual media services; and e-readers.
Paragraph 2 covers services supplied to consumers after 28 June 2025: electronic communications services, except machine-to-machine transmission; services that give access to audiovisual media; named elements of air, bus, rail and water passenger transport; consumer banking; e-books and the software dedicated to them; and e-commerce services. Paragraph 3 adds the answering of 112 emergency communications.
Paragraph 4 removes five content categories from the website and app duties: time-based media first published before that date, office file formats first published before it, online maps where essential navigational information is available in an accessible digital form, third-party content that the operator neither funds nor controls, and archives that are not updated or edited after that date. The exclusions are content-specific; they do not remove the service from scope.
What to do
- Inventory every product model and service with the date it was first placed on the market or first provided.
- Map each item to a paragraph 1 or paragraph 2 group, or record why it is outside.
- Check the paragraph 4 content exclusions one by one and date the evidence for each.
- Do not treat a content exclusion as a page-wide exemption.
Evidence to keep
- A dated product and service inventory with the first making-available date.
- A group mapping note citing Article 2(1)(a) to (e) or Article 2(2)(a) to (f).
- A content register that marks each excluded category and the evidence for it.
Dates
- 2025-06-28Products first supplied and services first provided from this date are covered. (Article 2(1), 2(2))
- 2025-06-28Cut-off for legacy time-based media and office files; later updates fall back in. (Article 2(4)(a), (b), (e))

Where teams get this wrong
The most common error is to ask whether the company is in scope. The question is whether each product model or service is. One legacy product can be outside while the app that sells it is inside.
